These sample dispute resolution clauses are provided for guidance purposes only. It is recommended that you consult JSI before adoption of these sample clauses. Some organisations may wish to adopt separate dispute resolution clauses for domestic and international disputes - one clause providing for final resolution of domestic disputes by JSI and another clause providing for a possible further appeal to the Court of Arbitration for Sport for disputes of an international nature. 1. Appeals Arbitration 1.1 For insertion into the statutes/regulations of a sporting organisation, providing for final resolution of all disputes by JSI All decisions issued by [the sporting organisation’s final internal instance of dispute resolution] may be appealed exclusively by referral to Just Sport Ireland, within 14 days from receipt of such decision, for final and binding arbitration in accordance with the Just Sport Ireland Arbitration Rules. 1.2 For insertion into the statutes/regulations of a sporting organisation, providing for the possibility of a further appeal to the CAS All decisions issued by [the sporting organisation’s final internal instance of dispute resolution] may be appealed exclusively by referral to Just Sport Ireland, within 14 days from receipt of such decision, for binding arbitration in accordance with the Just Sport Ireland Arbitration Rules. The arbitral award issued by JSI may be appealed exclusively by referral to the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland, within 21 days from receipt of such arbitral award, for final and binding arbitration in accordance with the CAS Code of Sports-related Arbitration. 2. Mediation 3.1 For insertion into the statutes/regulations of a sporting organisation, providing for resolution of all disputes by JSI Mediation All disputes arising out of or in connection with these [Statutes/Regulations etc] shall be referred to Just Sport Ireland for resolution by mediation in accordance with the Just Sport Ireland Mediation Rules. 3.2 For insertion into a contract/agreement, providing for resolution of all disputes by JSI Mediation All disputes arising out of or in connection with this [Contract/Agreement] shall be referred to Just Sport Ireland for resolution by mediation in accordance with the Just Sport Ireland Mediation Rules. 4. Combined Mediation/Arbitration 4.1 For insertion into the statutes/regulations of a sporting organisation, providing for final resolution of all disputes by JSI All disputes arising out of or in connection with these [Regulations/Statutes etc] shall be referred to Just Sport Ireland for resolution by mediation in accordance with the Just Sport Ireland Mediation Rules. If the dispute remains unresolved at the conclusion of the mediation process, the dispute shall be referred to Just Sport Ireland for final and binding arbitration in accordance with the Just Sport Ireland Arbitration Rules. 4.2 For insertion into the statutes/regulations of a sporting organisation, providing for the possibility of a further appeal to the CAS All disputes arising out of or in connection with these [Regulations/Statutes etc] shall be referred to Just Sport Ireland for resolution by mediation in accordance with the Just Sport Ireland Mediation Rules. If the dispute remains unresolved at the conclusion of the mediation process, the dispute shall be referred to Just Sport Ireland for binding arbitration in accordance with the Just Sport Ireland Arbitration Rules. Submission of existing dispute to Arbitration 5.1 For use where parties wish to submit a dispute, which has already arisen between parties, for resolution by JSI arbitration 1.
