JSI is aware that resources for many sports organisations and athletes are scarce. It is a principal aim of JSI that the mediation and arbitration facilities offered by it will be cost-effective.

Please click on the relevant link to find a summary of the costs involved in the facility of interest to you. The issue of costs shall be reviewed by Just Sport Ireland on an annual basis.

 

Mediation Costs

There are no pre-determined costs in relation to mediation. Instead, on receipt of a request for mediation the Registrar of JSI shall in conjunction with the appointed mediator fix a cost for the mediation. This costing will then be agreed with the parties prior to the commencement of the Mediation. There will be no obligation on the parties to proceed with the Mediation until the cost has been agreed.

This process will allow a costing to be determined which reflects the complexity and nature of the dispute at hand. This in turn will ensure best value for money for all parties to each dispute. JSI have issued an initial guideline pricing structure of €1,000 per party per day or €125 per party per hour where a mediation takes less time than one day to resolve. 75% of this fee will be paid to the mediator with the remaining 25% retained by JSI to cover administration and running costs. A filing fee of €150 must also be paid to initiate a mediation.

The nature of mediation requires that the costs once agreed be paid up front and be split equally between the parties. Please note that this does not preclude one party agreeing to refund the other party its half of the mediation costs as part of the overall settlement agreement.


Arbitration Costs

The Registrar of JSI shall on conclusion of an arbitration determine the costs of that arbitration to include any JSI administrative expenses, the fees and expenses of the Arbitration Panel together with the fees and expenses of any experts appointed by the Arbitration Panel.

JSI have issued an initial guideline pricing structure of €200 per party per hour for the arbitrator's fee. 75% of this fee will be paid to the arbitrator with the remaining 25% retained by JSI to cover administration and running costs. A filing fee of €250 must also be paid to initiate a arbitration.

Unless the parties agree otherwise, the Arbitrator shall as part of his/her award determine which party should bear, or in which proportion the parties should share the costs of the arbitration. Please note however that, save where the Arbitrator decides otherwise, each party shall be responsible for its own expenses incurred in connection with the arbitration for example, legal fees, witness costs and expenses and interpretation fees.

JSI does have the right to seek an advance on the costs of the arbitration and the amount of the advance may be readjusted at any time during the course of the arbitration proceedings. Once the arbitration costs have been determined on conclusion of the proceedings, any surplus amount shall be refunded to the parties.
